Listing Agent Terms and Conditions
("Agreement")

1.Acceptance of Term through use.

Before you can become a Listing Agent, you must read and agree to these Listing Agent Terms and Conditions. By upgrading your Membership, you ("Listing Agent ") are agreeing to these Listing Agent Terms and Conditions, and are agreeing to be legally bound by these rules. This agreement is subject to change by the owner, Intertainia Productions Incorporated ("Company"), of this Site, FindMeShelter.com ("Site"), at any time. The Company reserves the right to change this Agreement, and the Listing Agent will periodically check this Agreement for any changes. Changes are effective when posted on this site without notice upon each Listing Agent, and each Listing Agent is advised to check this Listing Agent Terms and Conditions for any changes, periodically. If you do not agree to these Listing Terms and Conditions, please do not continue in upgrading your Membership to a Listing Agent.

2.Legal Definitions.

• "Site", as referenced in this document means: The website in which you access these services, http://www.FindMeShelter.com.
• "Company", as referenced in this document means: The Site's owner and operator, Intertainia Productions Incorporated, a Pennsylvania Corporation.
• "Member", as referenced in this document means: any person who has completed the Site's registration process and possesses a Site valid email address and password.
• "Viewer", as referenced in this document means: any person who is viewing the material, using the Site Services, or accessing the Site.
• "House Ad", as referenced in this document means: a customized web-page presentation of information furnished by a Listing Agent about a single house and/or property.
• "Listing Agent", as referenced in this document means: the Member who is providing information, and/or making public information about the sale of a House and/or property on this Site.
• "Published/Active House Ad", as referenced in this document means: a House Ad having permission to be posted, and is searchable by Viewers of the Site.
• "Unpublished/Paused House Ad", as referenced in this document means: a Paid House Ad having permission to be posted, and has been removed from public viewing and is not searchable by Viewers of the Site.
• "Free House Ad", as referenced in this document means: an unpaid House Ad having having permission to be posted.
• "Paid House Ad", as referenced in this document means: an paid House Ad having having permission to be posted.
• "Deleted House Ad", as referenced in this document means: a House Ad placed in a state which declares it to be permanently removed from the Site.
• "Service", as referenced in this document means: Via the Company's Site, the Company shall manage, operate, and govern an Internet-based Classifieds System used to generate custom, searchable, web-pages containing information furnished by its Members/Listing Agents.
• "Agreement", as referenced in this document means: This Document; this Site's Listing Agent Terms and Conditions.

3.Site Use Policy, Membership Terms and Conditions, and Privacy Policy.

Listing Agent shall read, agree and periodically check for changes to this Site's Privacy Policy, Membership Terms and Conditions, Listing Agent Terms and Conditions, and Site Use Policy.

4.Listing Agent Eligibility.

The Listing Agent hereby warrants and represents that he or she meets all the following criteria:

The Listing Agent is NOT a minor, and in all respects is qualified and competent to enter into this Agreement.

 

The Listing Agent is allowed by local, and national laws to list a house or property for sale to the public, and agrees to read, understand, and abide by all laws and regulations governing the sale and transfer of property, such as but not limited to, the HUD's Fair Housing Laws.

 

The Listing Agent will only list houses and or property that is located in and govern by laws of the United States of America.

 

The Listing Agent will not post, imply or make false statements on this Site.

 

The Listing Agent will limit one house/property to one House Ad.

The Listing Agent is not using this Site or any of the Company Sites and Services to perform any acts that could be determined to be illegal or unauthorized by the Site's agreements and governing laws and regulations.

5.Web Site Ownership.

The Listing Agent understands that this Company is sole owner of code, material, and information, used, submitted or posted on this site. All House Ad Information is therefore property of the Company, and the Company may, but not limited to, publicly display House Ads, remove objectionable material, and investigate the accuracy of the information.

6.Listing Agent's Understanding of Site Agreements, Processes and Overall Operation.

Listing Agent will not initially join or purchase services, if he or she has any questions associated with the Services, the Site Use Policy, Membership Terms and Conditions, Listing Agent Terms and Conditions, Privacy Policy, Help/FAQ's, or the basic overall function of this Site. The Listing Agent is cordially invited to use the Site's "Contact Us" information to obtain the needed information he or she needs before joining.

7.Cancellation.

The Listing Agent can cancel his or her status as a Listing Agent at anytime, notifying, and receiving a confirmation, the Company of the Listing Agent's decision. Means of notifications for cancellations are as follows, and email (provided in the "Contact Us" section of the Site) to the Company with the words "Listing Agent Cancellation" in the subject line, or by Mail (address provided in the "Contact Us" section of the Site) displaying in the address, "Attention: Listing Agent Cancellation". Please refer to the Site's House Ad Refund terms. To provide security and protection to the Site's Members and Viewers, the Company reserves the right to cancel any Listing Agent's Membership, with or without reason, this includes, but not limited to, long period of inactivity with non-positive account balances, and Listing Agent providing false information.

8. House Ad Time Limits and Statuses.

• "Paid House Ads", (paid, posted and searchable) will become expired after 1 year(365 days) from date of purchase. During this year the, a House Ad can be removed from public viewing, and searching by changing the House Ad Status to "Paused House Ad" and return back to "Active House Ad" by the user anytime. After a House Ad has expired, it's status will be changed to "Free House Ad".
• "Active/Published Free House Ads", (unpaid, posted and searchable) have no time limit at this time.
• "Unpublished/Paused Free House Ads", (unpaid, unposted and unsearchable) can be removed from the system after a designated period of time determined by the Site's operators.
• "Deleted House Ads", (unposted and unsearchable, and marked for permanent removal), will be immediately removed from any search results, and agent property list. Although accidental deletions might be recovered if identified immediately, no guarantees are made to the ability to recover Listing Agent Ad Deletions. Note: Do not Delete House Ads unless you have completed a sale, or you have no intentions of using the House Ad again. If you have an Active House Ad, and you are in the process of transferring the House to a buyer, Pause the Ad and then Delete the House Ad after the closing is complete.

9.House Ad Refunds.

To help correct for any accidental purchases, FindMeShelter.com offers 100% refund for any House Ad purchase within the first 24 hours after the order is submitted.

10.NO WARRANTY.

THE COMPANY, SITE, OUR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OUR SUPPLIERS, AND OUR AGENTS PROVIDE OUR WEB SITE, MATERIAL, AND SERVICES "AS IS" AND WITHOUT ANY WARRANTY OR CONDITION, EXPRESS, IMPLIED OR STATUTORY. THE COMPANY, OUR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OUR SUPPLIERS, AND OUR AGENTS SPECIFICALLY DISCLAIM ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR PARTICULAR USE, NON-INFRINGEMENT, INFORMATION ACCURACY, INTEGRATION, INTEROPERABILITY OR QUIET ENJOYMENT. UNDER NO CIRCUMSTANCES THE COMPANY AND/OR ANY THIRD PARTIES BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT OR CONSEQUENTIAL DAMAGES OF ANY KIND, OR ANY DAMAGES WHATSOEVER (HOWEVER ARISING, INCLUDING BY NEGLIGENCE), INCLUDING, WITHOUT LIMITATION, DAMAGES RESULTING FROM LOSS OF USE, SALES, DATA, GOODWILL OR PROFITS, WHETHER OR NOT THE COMPANY HAS BEEN ADVISED OF SUCH POSSIBILITY. Some states do not allow the disclaimer of implied warranties, so the foregoing disclaimer may not apply to you. This warranty gives you specific legal rights and you may also have other legal rights that vary from state to state.

11.Limitation of Liability.

LISTING AGENT'S ONLY RIGHT WITH RESPECT TO ANY DISSATISFACTION WITH THIS SITE OR THE COMPANY, ITS SUPPLIERS OR AGENTS SHALL BE TO TERMINATE USE OF THIS SITE. FOR NON-PAYING LISTING AGENTS, UNDER NO CIRCUMSTANCES SHALL THE COMPANY BE LIABLE TO YOU FOR ANY AMOUNT ARRISING FROM ACCESS, USE, OR VIEWING OF THIS SITE. FOR PAYING LISTING AGENTS, THE COMPANY'S ENTIRE LIABILITY IS LIMITED TO THE FEES PAID BY THE LISTING AGENT TO THE COMPANY UNDER THESE LISTING AGENT TERMS AND CONDITIONS, AND NOT YET RENDERED.

12.Indemnity.
